Höchstens ein halbes Jahr Sperre

Die Hoffenheimer Zu-Spät-Kommer Andreas Ibertsberger und Christoph Janker dürften mit einer Sperre von höchstens sechs Monaten davonkommen; für eine härtere Strafe dürfte keine rechtliche Grundlage bestehen. Für den deutschen Profi-Fußball gelten die Anti-Doping-Richtlinien des DFB. Sie regeln, nach Vorgabe des Wada-Codes, wann ein Doping-Vergehen vorliegt. Sanktionen für ein Doping-Vergehen regelt die Rechts- und Verfahrensordnung des DFB. Die Rechts- und Verfahrensordnung des DFB sieht in § 8 Abs. 3a eine Sperre von zwei Jahren für einen Spieler vor, dem entweder die Einnahme von Doping nachgewiesen wurde oder der sich geweigert hat, eine Probe abzugeben. Nachdem, was in der Presse verlautbart wurde, trifft für die zwei Hoffenheimer Profis beides nicht zu. Sie sind eben „nur“ zu spät gekommen. Die Strafe kann auf ein Jahr reduziert werden, wenn die Spieler nachweisen können, dass sie weder vorsätzlich, noch grob fahrlässig gehandelt haben. Trifft sie gar kein Verschulden, bleibt ihr Verhalten sanktionslos.
§ 7 Abs. 1 Satz 2 der DFB-Anti-Doping-Richtlinien verlangt, dass sich die zur Probenabgabe berufenen Spieler unverzüglich nach Spielende direkt vom Spielfeld zur Dopingkontrolle begeben. Was es für Folgen hat, wenn die Spieler dort nicht unverzüglich erscheinen und etwa noch in der Kabine das Trikot wechseln oder eine Dusche nehmen, ist allerdings in der Rechts- und Verfahrensordnung des DFB nicht geregelt. Ist § 7 Abs. 1 Satz 2 daher eine reine Ordnungsvorschrift ohne Rechtsfolge?
Nicht ganz. Denn nach § 8 Abs. 3d der Rechts- und Verfahrensordnung des DFB wird bei sonstigen Verstößen gegen die DFB-Anti-Doping-Richtlinien eine Sperre von zwei Wochen bis sechs Monaten verhängt. Mehr als ein halbes Jahr Sperre ist damit nicht möglich.
Der Fall ist ein Paradebeispiel dafür, dass das DFB-Regelwerk in dieser Form anzuwenden ist. Das Verhalten der Spieler der TSG Hoffenheim soll nicht straflos bleiben. Die Festsetzung einer Sperre zwischen zwei Wochen und sechs Monaten dürfte aber zu einer gerechten Lösung führen. Der Unterschied im Strafmaß ist sachgerecht. Die Verweigerung der Doping-Probe macht nicht nur die Doping-Kontrolle unmöglich, sondern offenbart auch eine Verweigerung des Spielers gegen das gesamte Doping-Kontroll-System. Deshalb muss sie besonders hart geahndet werden. Das verspätete Erscheinen ermöglicht immerhin die Kontrolle, auch wenn es dem Spieler die Chance der Manipulation offen lässt. Ein Abschlag im Strafmaß ist daher angemessen. Auch verschafft der Strafrahmen der Sportgerichtsbarkeit den Ermessensspielraum, je nach Dauer und weiteren Umständen der Verspätung, das Strafmaß festzulegen.
Wenn es da nicht eine aktuelle Entscheidung des Cas (Court of Arbitration for Sport) gäbe, der das Zu-Spät-Kommen zum Doping-Test einer Verweigerung der Kontrolle gleichstellt. Der Cas ist ein Schiedsgericht, das als höchste Instanz der Sportgerichtsbarkeit über Disziplinarmaßnahmen im Sport (zum Beispiel auch in Dopingfällen) entscheidet. Seine Legitimität ist allerdings umstritten.
In einem Verfahren gegen zwei italienische Fußballprofis hat der Cas eine einjährige Sperre verhängt. Die beiden Profis waren auf dem Weg zur Dopingkontrolle zu einer Mannschaftsbesprechung in die Kabine gerufen worden und haben die Dopingproben mit fünfundzwanzigminütiger Verspätung abgegeben. Grundlage der Entscheidung des Cas waren die aufgrund des Wada-Codes mit dem DFB-Regelwerk nahezu übereinstimmenden italienischen Anti-Doping-Regularien Der Cas war der Auffassung, die Verspätung komme einer „Verweigerung“ der Dopingkontrolle gleich. Der Begriff „Verweigerung“ sei im Lichte der Verpflichtung der Spieler, unverzüglich nach Spielende zur Dopingkontrolle zu erscheinen, auszulegen. Vor diesem Hintergrund sei die verspätete Abgabe der Doping-Probe als Verweigerung zu qualifizieren.
Die DFB-Jurisdiktion, die über den „Hoffenheimer“ Fall zu entscheiden hat, ist jedoch nicht an die Rechtsprechung des Cas gebunden. An der Richtigkeit der Auffassung des Cas sind zudem große Zweifel angebracht.

Auch du, Kloppo? Auch Jürgen Klopp gab sich gestern (WDR, Sport Inside) als Verharmloser in der „Hoffenheim-Frage“. Vielleicht war das Fillmaterial einseitig geschnitten oder er wollte Solidarität mit den Hoffenheimern ausdrücken. Dennoch hab ich den Eindruck, dass keiner in der Branche weiß, dass sich manche Sorgen machen um den Fußball. Auch weil die meisten es auf die leichte Schulter zu nehmen scheinen. Zum DFB-Strafmaß von 2 Wo bis 6 Mo kommt man nur, wenn man zu Beginn gleich die weichenstellung vornimmt indem man sagt es läge kein Dopingvergehen vor, weil kein Dopingnachweis und keine Verweigerung, weil ja nach 10 Minuten die Probe abgegeben wurde.
Dabei gilt jedoch der Ausspruch „iudex non calculat“.
Ob jemand 10 Minuten oder 25 Minuten wie in Italien zu spät kommt ist irrelevant.
Der Sinn und Zweck der sofortigen Abgabe (Verhinderung vn Manipulationsmöglichkeiten) wurde auch im Hoffenheimer Fall zunichte gemacht. Daher würde ich sehr vorsichtig sein, mit einer apodikitischen Bewertung, es läge keine Verweigerung vor.
Wenn ich DFB-Ankläger wäre, dann würde ich definitiv eine Verweigerung, die halt 10 Minuten angedauert hat, annehmen.

Wer als Profi von dem System, welches die Ausübung seiner Profession ermöglicht, profitiert, hat sich auch an die hierzu aufgestellten Regeln zu halten. Der Profisport im Allgemeinen leidet unter dem stets latenten Dopingverdacht. Würde nicht alles getan, um zu belegen, dass „sauberer Sport“ präsentiert wird, so nähme der Marktwert des den Medien und den Fans angedienten Produktes und somit letztlich auch die Verdienstmöglichkeiten der Akteure ab. Die WADA, an deren Regeln sich auch der DFB gebunden hat, hat sich somit dafür entschieden, die „Erlaubnis“, Profisport zu betreiben, davon abhängig zu machen, dass der Sportler sich bereit erklärt jederzeit nachzuweisen, dass er „sauber“ ist. Es gilt also keinesfalls die Unschuldsvermutung. Eine derartige Regelung ist rechtlich durchaus nicht zu beanstanden, da es sich vorliegend um ein vertragliches Konstrukt handelt.
Die beiden Hoffenheimer Spieler haben es nunmehr durch ihr Verhalten verhindert, dass bei ihnen der Nachweis fehlenden Dopings geführt werden konnte. Eine Manipulation war schließlich möglich. Wie soll nunmehr auch nachgewiesen werden, dass eine solche nicht erfolgt ist? Das Verhalten der Spieler offenbart die fehlende Verinnerlichung der Bedeutung des Anti-Doping-Kampfes. Man war – auch seitens der Vereinsverantwortlichen – augenscheinlich der Auffassung, dass man auch „’mal Fünfe gerade sein lassen“ kann. Hieran hat sich angesichts der öffentlichen Verlautbarungen bis dato schließlich auch nichts geändert. Ohne wenn und aber liegt demnach ein schwerwiegender Vertragsverstoß vor.
Der internationale Sportgerichtshof CAS hatte sich im Falle der italienischen Spieler an den Regeln der WADA (akzeptiert vom italienischen Verband) zu orientieren. Das dort gesprochene Urteil ist als angemessen zu betrachten. Die Regelsperre von zwei Jahren wurde entsprechend der Möglichkeiten auf die Hälfte (das Mindestmaß, welches nach der Regel zur Abschreckung und Läuterung sowie zum Schutz des Kontrollsystems als für erforderlich erachtet wurde) reduziert. Hieran wird sich auch der DFB orientieren müssen. Man wird sich dort nicht hinter den eigenen Regeln verstecken können, will man seinen Obliegenheiten gegenüber der WADA nachkommen.

Zunächst möchte ich zu bedenken geben, dass bereits eine halbjährige Sperre für eine Erstligafussballer eine sehr empfindliche Sanktion darstellt.Handelt es sich z.B. um einen Spieler, der Ambitionen hätte, zur Weltmeisterschaft zu fahren, könnte er diese womöglich infolge der Sperre begraben. Bei einer Zwei-Jahres-Sperre – oder auch eine auf 1 Jahr verkürzte Sperre – handelt es sich nicht nur um eine harte Sanktion, sondern um ein – sagen wir mal – pauschales Strafmaß, bei dem besondere Umständen des Einzelfalls keine Berücksichtigung mehr finden. Da ich sehr wohl finde, dass die Gründe – und auch die Dauer – einer Verspätung zur Dopingprobe bei der Festlegung der Höhe des Strafmaßes Berücksichtigung finden müssen, bietet die in § 8 Abs. 3d der Rechts- und Verfahrensordnung des DFB festgelegte „Rahmenstrafe“ eine Ausgangsbasis für eine angemessene Sanktionierung.
Ich gebe aber zu, dass man überlegen könnte, die Strafobergrenze bei dieser Norm zu erhöhen. Ich gebe auch zu, dass irgendwo eine Grenze sein muss, ab der man nicht mehr von einer Verspätung, sondern einem Unterlassen der Probe ausgehen muss.
Das bedeutet aber nicht, dass man – getreu dem Motto „was nicht passt wird passend gemacht“ – am Wortlaut des Regelwerks vorbei eine Sanktion verhängen kann.
Das bestehende DFB-Regelwerk ist aus meiner Sicht unausgegoren. Nur die „Verweigerung“ oder die (auch versuchte) „Manipulation“ der Probennahme zieht eine 2-Jahres-Sperre nach sich. Ibertsberger und Janker haben eine Probennahme – soweit mir bekannt ist – nicht verweigert. Auch ist Ihnen kein Versuch einer Manipulation – geschweige denn eine vollendete manipulation – nachgeweisen worden. Ergo: § 8 Abs. 3a der DFB Rechts- und Verfahrensordnung ist nicht einschlägig!
Es liegt aber ein Verstoß gegen die DFB-Anti-Doping-Bestimmungen im übrigen vor. Dafür gilt § 8 Abs. 3d mit dem bekannten Strafrahmen.
Die Regularien zu überarbeiten wäre nicht schlecht…
